Anyone who rents out property on a short-term basis (such as on airbnb) must declare it by 30 November

CORFU. Anyone who rents out property via the AirBNB platform has to declare it on the Independent Authority for Public Revenue (AADE) platform.

Anyone who has received rental from short-term lets such as those on airbnb since 1 January 2018 has until 30 November to register on the 'Short-term Accommodation Property Register'.

The Independent Authority for Public Revenue (AADE) has issued a circular regarding short-term lets in which it states that those concerned must submit a 'Short-term Accommodation Property Declaration' for each of their properties by 30 November. This must include all the rental revenue they received between 1 January 2018 and 30 August 2018, when the application started operation.

Whoever doesn't declare their properties will face fines of up to 5,000 Euros as there is a legal obligation to declare short-term rental revenue for the period since 1 January. The creation of a digital platform for airbnb income to be declared was approved in December 2016 but there have been a series of delays in its implementation - first it was put back to the end of 2017, then March 2018, then July 2018 and finally the end of August.

A fine of 5,000 Euros will be imposed in the following instances:

- Non-registration on the Short-term Accommodation Property Register.

- Non-displayal of the 'Short-term Accommodation Property Register' Reference Number on digital platforms and other means of promotion.
- Non-displayal of the Authorised Licence Number on digital platforms and other means of promotion by those who are not obliged to register on the Short-term Accommodation Property Register.

AADE has announced that on the website www.aade.gr the following have now been implemented:

a. Short-term Accommodation Property Register and
b. Application for the digital submission of the Short-term Accommodation Property Declaration on a special calendar which allows a detailed overview of the declarations.

Access to these applications is via a personal TAXISnet password for Managers of Short-term Let Properties. Each property is then submitted individually to the Short-term Accommodation Property Register and a Property Registration Number (AMA) is automatically issued electronically.

Legal obligations

A. The operator of a short-term let property is considered to be the individual or legal entity that is responsible for the posting of a property on a digital platform for the purpose of letting it on a short-term basis and has general responsibility for the short-term rental of the property. The operator can be the owner, tenant, subtenant or third party.

B. To let a property on a short-term basis via a digital platform the following are required:

1. Registration as property operator on the AADE Short-term Accommodation Property Register.

- If the operator is also the property owner, the owner's Property Identity Number (AAK) must be given.
- If the operator is not the owner, then a declaration must be submitted in which the owner authorises the letting of the property. The operator's registration must then include the reference number of the above declaration.

2. The Property Registration Number or the Authorised Licence Number must be clearly displayed when the property has been posted on digital platforms for the purpose of short-term lets. Tourist properties will not be given a Property Registration Number but they must be submitted to the Short-term Accommodation Property Register in order to be able to submit the Short-term Accommodation Property Declaration.

C.  Operators of a short-term let properties are obliged to submit a Short-term Accommodation Property Declaration in order to determine annual income.


Amendments:

- Short-term Accommodation Property Declarations must be submitted by the 20th of the following month after those renting the property have departed.

- For short-term lets from 1/1/2018 until 30/8/2018, when the Short-term Accommodation Property Register started operating, property operators are obliged to do the following by 30 November 2018:

a. Register on the Property Register
b. Submit Short-term Accommodation Property Declarations for each property with all the rental revenue for the period 1/1 - 30/8 2018.

In order to assist the public in fulfilling their obligations, AADE is in contact with digital platforms involved in short-term lets (Airbnb, Booking.com, Home Away) to ensure proper collaboration and welcomes collaborative initiatives from the other platforms.
